Welcome to TOWAH! These Terms of Service ("Terms") govern your use of the TOWAH platform, website, and mobile application (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using TOWAH's services, you confirm that you have read, understood, and agree to these Terms of Service, our Privacy Policy, and any other guidelines or policies published on our platform. If you do not agree, please discontinue use of our Service immediately.

2. Description of Service

TOWAH is a fitness platform that connects users with premium gym facilities across India. Our Service allows users to:

• Browse and search for gyms and fitness centers
• Book gym sessions with daily, weekly, monthly, or yearly passes
• Join fitness classes conducted by certified trainers
• Track fitness progress and manage bookings
• Make secure payments through integrated payment gateways

3. User Accounts

3.1 Registration

To use certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirement

You must be at least 18 years old to use our Service. By using TOWAH, you represent and warrant that you meet this age requirement.

4. Bookings and Payments

4.1 Booking Policy

When you book a gym session or fitness class through TOWAH, you enter into a contract directly with the respective gym or fitness facility. TOWAH acts as a facilitator of this transaction.

4.2 Payment Processing

All payments are processed securely through our integrated payment gateway (Razorpay). By making a payment, you authorize us to charge your chosen payment method for the booking amount.

4.3 Pricing

All prices displayed on TOWAH are subject to change without notice. However, prices are guaranteed at the time of booking confirmation.

4.4 Refunds and Cancellations

• Cancellations must be made before the subscription becomes active to be eligible for a refund
• Once a subscription is active, cancellations may not be eligible for refunds
• Daily passes may have different cancellation policies as determined by individual gym facilities
• Refunds, when applicable, will be processed within 7-10 business days

5. User Conduct

You agree not to:

• Violate any applicable laws or regulations while using our Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use the Service for any fraudulent or unlawful purpose
• Attempt to gain unauthorized access to any portion of the Service
• Upload or transmit viruses, malware, or any other malicious code

6. Gym Facility Rules

When visiting gym facilities through TOWAH, you agree to comply with all rules, regulations, and policies of the respective gym. TOWAH is not responsible for any disputes between users and gym facilities regarding facility rules or conduct.

7. Intellectual Property

All content, features, and functionality of the TOWAH Service, including but not limited to text, graphics, logos, images, and software, are the exclusive property of TOWAH or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Disclaimers and Limitations of Liability

9.1 Service Disclaimer

TOWAH provides the Service on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the Service's reliability, accuracy, or availability.

9.2 Health and Safety

You acknowledge that physical exercise and gym activities carry inherent risks. You should consult with a healthcare professional before engaging in any fitness activities. TOWAH is not responsible for any injuries, damages, or health issues arising from gym usage.

9.3 Limitation of Liability

To the maximum extent permitted by law, TOWAH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless TOWAH, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Modifications to Terms

TOWAH reserves the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Termination

TOWAH may suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TOWAH regarding the use of our Service.
